Welcome to Photography Management System by Legacy Photography. These Terms of Service ("Terms") govern your use of our photography business management platform. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using Photography Management System, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree, you may not use our services.

2. Service Description

Photography Management System provides a comprehensive business management platform for professional photographers, including:

• Session scheduling and management
• Client gallery hosting and delivery
• Invoicing and payment processing
• Contract management with e-signatures
• Website building tools
• Cloud storage for photos and RAW files
• Integrated communication tools (call, text, email)
• Business analytics and reporting
• Community platform features
• AI-powered content generation tools

3. Account Registration

Eligibility

• You must be at least 18 years old
• You must provide accurate and complete information
• You are responsible for maintaining account security
• One account per business entity

Account Responsibilities

• Keep your login credentials confidential
• Notify us immediately of unauthorized access
• You are responsible for all activities under your account

4. Subscription and Payment

Professional Plan

• Monthly subscription: $97/month
• First month promotional: 50% off
• Includes 100GB storage
• Additional storage: $25/TB monthly

Payment Terms

• Payments processed securely through Stripe
• Subscriptions renew automatically
• Cancel anytime; access continues until end of billing period
• No refunds for partial months

5. Acceptable Use Policy

You agree not to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Upload malicious code or harmful content
• Harass, abuse, or harm others
• Attempt to gain unauthorized access
• Use the platform for illegal activities
• Resell or redistribute services without permission
• Upload content that violates photography industry standards

6. Content Ownership and License

Your Content

• You retain ownership of all photos and content you upload
• You grant us a limited license to host and display your content
• You are responsible for obtaining necessary rights and releases

Our Content

• We retain ownership of the platform and its features
• Templates, designs, and tools remain our property
• You may use our tools for your business operations

7. Client Data and Privacy

• You are responsible for your clients' data
• Must comply with applicable privacy laws
• Obtain necessary consents from clients
• Handle client information securely and ethically

8. Service Availability

• We strive for 99.9% uptime
• Scheduled maintenance will be communicated in advance
• No guarantee of uninterrupted service
• Not liable for temporary unavailability

9. Intellectual Property

• Respect copyright and trademark rights
• Only upload content you have rights to use
• Report any infringement to us immediately
• We may remove infringing content without notice

10. Third-Party Services

Our platform integrates with third-party services including:

• Stripe for payment processing
• SendGrid for email delivery
• Twilio for SMS services
• Cloudflare R2 for storage
• WHCC for print fulfillment (coming soon)

Use of these services is subject to their respective terms.

11. Limitation of Liability

To the maximum extent permitted by law:

• Services provided "as is" without warranties
• Not liable for indirect, incidental, or consequential damages
• Total liability limited to amount paid in last 12 months
• Not responsible for lost profits or data loss

12. Indemnification

You agree to indemnify and hold harmless Legacy Photography from any claims, damages, or expenses arising from:

• Your use of the platform
• Violation of these Terms
• Infringement of third-party rights
• Your client relationships and business operations

13. Termination

By You

• Cancel subscription anytime through your account
• Request account deletion via support

By Us

• For violation of these Terms
• For non-payment
• For illegal or harmful activities
• At our discretion with 30 days notice

14. Data Export and Portability

• Export your data anytime in standard formats
• 90-day grace period after cancellation
• Automated backup available for disaster recovery

15. Modifications to Terms

• We may update these Terms periodically
• Material changes communicated via email
• Continued use constitutes acceptance

16. Governing Law

These Terms are governed by the laws of the United States and the state in which Legacy Photography operates, without regard to conflict of law principles.

17. Dispute Resolution

• First attempt informal resolution
• Binding arbitration for unresolved disputes
• Class action waiver applies
